SUBSCRIBER AGREEMENT AND TERMS OF SERVICE
DanStudyPath and DanSprout Stories
Operator: 4Learn Motto LLC, a Maryland limited liability company ("Company," "we," "us")
Services: danstudypath.com and dansprout.com, including all subdomains, applications, content, and features (the "Services")
Contact: contact@4learnmotto.com
Version: 1.1 — Effective October 21, 2026
PLEASE READ CAREFULLY. BY CREATING AN ACCOUNT, CLICKING "I AGREE," OR TYPING YOUR NAME IN THE SIGNATURE FIELD AT SIGNUP, YOU ENTER INTO A BINDING AGREEMENT WITH 4LEARN MOTTO LLC ON THE TERMS BELOW — INCLUDING THE AUTO-RENEWAL TERMS IN SECTION 5, THE WARRANTY DISCLAIMERS IN SECTION 12, THE LIABILITY LIMITS IN SECTION 13, AND THE ARBITRATION AND CLASS-ACTION WAIVER IN SECTION 15 (WHICH INCLUDES A 30-DAY OPT-OUT).
1. Who may sign — grown-ups only
1.1 The Services are offered to adults (18 years or older) only. Accounts may be created and paid for only by a parent or legal guardian (the "Account Holder," "you"). Children use the Services only through an Account Holder's account, under that Account Holder's supervision.
1.2 By signing, you represent and warrant that: (a) you are at least 18 years old; (b) you are the parent or legal guardian of each child you enroll, or are otherwise legally authorized to consent on that child's behalf; and (c) all information you provide is accurate and will be kept current. If you are not the parent or legal guardian of a child, do not enroll that child.
1.3 You are responsible for all activity under your account, including activity by each enrolled child and by anyone you allow to use your login.
2. Parental consent to data practices (COPPA)
2.1 The Services are designed for children under 13 to use with parental involvement. By signing this Agreement and creating learner profiles, you consent to our collection, use, and disclosure of information from and about your enrolled children as described in the Privacy Policy (incorporated into this Agreement by reference), for the purpose of providing and improving the educational Services — including practice content, step-by-step lessons, progress tracking, personalized stories, vocabulary features, narration, and the parent dashboard. For DanSprout Stories, this consent expressly includes using the details you provide about your child — such as first name, interests, and reading goal — to generate and personalize stories, illustrations, vocabulary words, and narration for your family's private library.
2.2 Your rights: you may review your child's information, direct us to delete it, and refuse further collection at any time through your account settings or by contacting contact@4learnmotto.com. Deleting a learner profile or closing your account ends this consent for that child. We do not sell children's personal information, do not show advertising in the Services, and do not provide chat between children and strangers.
2.3 Consent under this Section may be provided only by the Account Holder. A child's use of the Services is not consent and creates no independent account or contract with the child.
2.4 Story review and deletion tools (DanSprout Stories). Before a generated story is saved to your family library, we prompt you to review it for personal information. You may edit the personalization details, save the story, or delete it, and you may delete any saved story at any time from your library. Unsaved draft stories are automatically deleted after 30 days. Prompts and deletion tools are available only in the grown-up account, not in a child's view.
3. What the Services are — and are not
3.1 The Services provide supplemental educational practice and reading content for Pre-K through 8th grade in mathematics, English language arts, science, and social studies (DanStudyPath) and personalized illustrated reading stories (DanSprout Stories).
3.2 The Services are not a school, are not accredited instruction, are not a substitute for classroom teaching, tutoring, or professional educational evaluation, and do not provide medical, therapeutic, psychological, or special-education diagnosis or advice.
3.3 No outcome guarantee. We do not promise or guarantee any academic result, including grades, test scores, reading levels, school placement, or learning progress for any child. Every child's progress depends on many factors outside our control.
4. Educational content
4.1 We work to keep questions, answers, explanations, and stories accurate and appropriate for the stated grade level. Even so, content may occasionally contain errors, omissions, or material that does not match your child's individual curriculum, school, state standards, or learning needs.
4.2 You agree to use the Services as supplemental practice only, to review your child's activity through the parent dashboard, and to tell us about any error you find at contact@4learnmotto.com. Reporting an error does not create a claim for damages beyond the remedies in Sections 7 and 13.
4.3 Generated content (DanSprout Stories). DanSprout stories, illustrations, and narration are generated by computer software, including automated and AI-assisted tools, from the details you provide. Generated content is produced for your family's personal reading enjoyment and practice; it is not professionally authored, edited, or published material, and it may occasionally contain errors, inconsistencies, repeated passages, or content that does not match a requested theme or an exact reading level. You agree to preview stories before or while your child reads them and to tell us about anything inappropriate at contact@4learnmotto.com so we can remove or correct it. Generated stories are licensed to your family for personal, non-commercial use only; they may not be sold, published, or redistributed. You represent that the details you provide for personalization are yours to provide, and you agree that we may use de-identified inputs and outputs to operate and improve the story-generation features.
5. Free trial, subscriptions, and AUTO-RENEWAL
5.1 Free lesson / free account. Some features are available free. A free grown-up account requires no payment card.
5.2 Free trial. If offered, a paid plan begins with a free trial of the length shown at signup (currently 7 days). No charge is made during the trial. Unless you cancel before the trial ends, the paid subscription begins automatically at the end of the trial and your payment method will be charged.
5.3 AUTO-RENEWAL — PLEASE READ. Paid subscriptions renew automatically at the end of each billing period (monthly or yearly, as shown at checkout) at the then-current price for your plan — as shown for your plan at signup and on the final checkout screen — and your payment method will be charged on or about the renewal date, until you cancel. If you subscribe to DanSprout Stories under a separate or bundled plan, the price, learner limits, and trial terms shown on the DanSprout checkout apply in exactly the same way, and references in this Agreement to your "plan" include that plan. By starting a trial or paid plan, you authorize us and our payment processor to store your payment method and charge it for each renewal.
5.4 Your separate affirmative consent to these auto-renewal terms is collected at checkout (unchecked box) and is part of this Agreement. Immediately after signup we email you an acknowledgment restating these terms and how to cancel.
5.5 Price changes. If a plan price changes, we will notify you by email at least 30 days before the change takes effect for your account, and the new price will apply only to billing periods after that notice. If you do not agree, cancel before the change takes effect.
5.6 Taxes. Prices exclude any applicable taxes, which may be added at checkout based on your location and collected/remitted as required by law.
6. Billing and payments
6.1 Payments are processed by Stripe or another disclosed processor. We do not store full payment-card numbers on our systems. You authorize the processor to charge your selected payment method for all amounts due under your plan.
6.2 Keep your payment method current. If a charge fails, we may retry it, suspend paid features, or convert the account to the free tier after notice. You remain responsible for amounts properly charged before cancellation.
6.3 Chargebacks. If a payment dispute arises, please contact us first at contact@4learnmotto.com so we can resolve it. Filing a chargeback for amounts properly charged under this Agreement may result in suspension of the account while the dispute is resolved. Nothing in this Section limits any right you have under applicable law.
7. Cancellation and refunds
7.1 You may cancel at any time, from your account settings or by emailing contact@4learnmotto.com. Cancellation takes effect at the end of the current billing period; paid features remain available until then, and no further renewals will be charged.
7.2 Except where required by law, charges already paid are non-refundable, including for partial periods and unused learner seats. Where a refund is required by law, or granted at our discretion, it is your sole remedy for the related charge.
8. License, ownership, and no copying
8.1 All content in the Services — questions, answers, explanations, lessons, stories, illustrations, audio, software, and design — is owned by the Company or its licensors and is protected by copyright and other laws.
8.2 We grant you a limited, revocable, non-transferable license to use the Services for your enrolled children's personal, non-commercial educational use, within the learner-seat limits of your plan.
8.3 You agree not to: copy, scrape, bulk-download, harvest, reproduce, sell, redistribute, or create derivative works from any question bank, story, explanation, or other content; share your account beyond your plan's learner seats; use automated tools (bots, crawlers, scrapers) against the Services; circumvent access controls or rate limits; or reverse-engineer the Services except where this restriction is prohibited by law. Breach of this Section is a material breach and may result in immediate termination without refund, in addition to any other legal remedies.
9. Acceptable use and account security
9.1 Do not misuse the Services, attempt to access another family's data, upload unlawful or harmful material, or use the Services for any unlawful purpose.
9.2 Keep your password confidential. Notify us promptly of any unauthorized use. We may suspend accounts that threaten the security of the Services or of other families' data.
10. Data, progress records, and feedback
10.1 Learner answers, progress, and story data generated under your account are used to operate and improve the Services as described in the Privacy Policy. You grant us the rights needed for those purposes. We do not sell children's personal information.
10.2 If you send us suggestions or feedback, you grant us a royalty-free, perpetual right to use them without obligation to you.
11. Third-party services
The Services rely on third-party providers (including hosting, email, speech/narration, and payment processing). We are not responsible for outages or acts of third-party providers outside our reasonable control, and third-party terms may apply to their components.
12. Warranty disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR ERROR-FREE CONTENT, AND UNINTERRUPTED AVAILABILITY. Some jurisdictions do not allow certain disclaimers; in those jurisdictions, this Section applies to the maximum extent permitted, and nothing in this Agreement limits any right that cannot lawfully be waived.
13. Limitation of liability
13.1 TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR ACADEMIC OUTCOMES, ARISING FROM OR RELATED TO THE SERVICES — EVEN IF ADVISED OF THE POSSIBILITY.
13.2 THE COMPANY'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICES OR THIS AGREEMENT WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO THE COMPANY IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100.
13.3 These limits do not apply to liability that cannot lawfully be limited, including liability arising from gross negligence or willful misconduct.
14. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless the Company from third-party claims, damages, and reasonable legal costs arising from: (a) your breach of this Agreement; (b) your misuse of the Services, including enrolling a child without legal authority; (c) your violation of another person's rights or of applicable law through your account. This Section does not require you to indemnify the Company for its own negligence or misconduct.
15. Dispute resolution — arbitration and class-action waiver
15.1 Talk first. Before filing any claim, you and we agree to try to resolve the dispute informally by email (contact@4learnmotto.com) for 30 days.
15.2 Binding arbitration. Except for claims that qualify for small-claims court, any dispute arising from or relating to the Services or this Agreement will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Maryland, rather than in court. You and we waive any right to a jury trial and to participate in a class action, class arbitration, or representative proceeding. The arbitrator may award the same relief a court could award to you individually.
15.3 Opt-out. You may opt out of this Section 15.2 within 30 days of accepting this Agreement by emailing contact@4learnmotto.com with the subject "Arbitration Opt-Out" and your account email. Opting out does not affect any other term.
15.4 If any part of this Section is found unenforceable, the remainder still applies, and the unenforceable part will be handled in a Maryland court under Section 16.
16. Governing law and venue
This Agreement is governed by the laws of the State of Maryland, without regard to conflict-of-law rules. For any claim not subject to arbitration, the state and federal courts located in Maryland are the exclusive venue, and you consent to their jurisdiction. Nothing in this Section deprives you of protections of your home jurisdiction that cannot lawfully be waived.
17. Termination
You may close your account at any time. We may suspend or terminate accounts for material breach (including Sections 8 and 9), non-payment, or unlawful use, with notice where reasonably practicable. On termination, licenses end; charges properly incurred remain due; data is handled as described in the Privacy Policy; Sections 8, 12–16 and 18 survive.
18. Changes to this Agreement
We may update this Agreement. For material changes, we will notify you by email or in-product notice at least 15 days before the change takes effect, and continued use or the next renewal after that date constitutes acceptance. If you do not agree to a material change, cancel before it takes effect. The version you accepted, and your acceptance record, are retained as described in Section 19.
19. Electronic signature, records, and notices
19.1 Electronic agreement. Clicking "I AGREE," checking the acceptance boxes, and/or typing your full legal name in the signature field is your electronic signature to this Agreement, with the same effect as a handwritten signature under applicable electronic-signature law (including the federal ESIGN Act and Maryland UETA).
19.2 We retain an acceptance record for each account: the version of this Agreement accepted, the date and time, the account email, and the acceptance actions taken. You may request a paper or PDF copy of the version you accepted at any time by emailing contact@4learnmotto.com.
19.3 Notices to you are effective when sent to your account email. Notices to us are effective when received at contact@4learnmotto.com.
20. General terms
This Agreement (with the Privacy Policy) is the entire agreement between you and the Company about the Services and replaces prior understandings on that subject. If any provision is held unenforceable, the rest remains in effect and the provision will be read to the minimum extent necessary to make it enforceable. Our failure to enforce a term is not a waiver. You may not assign this Agreement; we may assign it in connection with a sale, merger, or reorganization of the Company. Headings are for convenience only.
